Product Descriptions and Guarantees

Description and Specification of Products

While we endeavour to ensure that the information and content of this website is accurate, we cannot guarantee the completeness of the material covered. We reserve the right to make changes to product design, descriptions, prices, specifications and any other content without notice. While we are constantly striving to ensure material is up-to-date, we make no assurances that the information is current.

Product Colours

As ash is a natural product, no two pieces are identical. By placing an order with us you acknowledge that individual products and/or parts within a product will differ in regards to the shade and grain of wood used. We reserve the right to change any and all materials and/or parts used in the manufacture of our products without notice.

CBC Furniture Guarantees

All furniture manufactured by Childrens Bed Centres is supplied with a 24 month guarantee from the date of delivery. This guarantee covers products under normal usage and storage conditions. If we are advised that a product has a fault within our guarantee period, the decision as to whether a product has been damaged under normal usage and storage conditions lies solely with us. If a product has been deemed damaged intentionally or through misuse we reserve the right to terminate the guarantee and are not liable for the cost of repair or replacement of the product.

Mattress Warranty

CBC mattresses come with a 60 month warranty against faults. Any products which suffer from either poor workmanship or manufacturing defect within the first 12 months will be replaced free of charge by our supplier, subject to the following. After 12 months a sliding scale of usage charge will be made against the retail price in operation at that time. 12-24 months 20% charge, 25-36 months 40% charge, 37-48 months 60% charge, 49-60 moths 80% charge. This warranty covers products under normal usage and storage conditions, as described in the care instructions leaflet supplied with all mattresses. If we are advised that a product has a fault within the warranty period, the decision as to whether a product has been damaged under normal usage and storage conditions lies solely with Children´s Bed Centres and our suppliers. If a product has been deemed damaged intentionally or through misuse we reserve the right to terminate the warranty and are not liable for the cost of repair or replacement of the product.

Accessories Guarantees

Childrens Bed Centres makes every effort to source good quality, tasteful products from reliable suppliers. Where a guarantee applies to a product, it is specified in the product description. If there is no mention of a guarantee, none applies and customers should refer to the returns section of these terms and conditions for details on when a refund or replacement is available.

Pricing & Payment

Pricing

Prices and charges that are displayed in Sterling on our website are inclusive of VAT and may be subject to change without notice. Products listed as accessories on our website are inclusive of delivery. In the case of furniture and mattresses, delivery is charged for separately. Your contract and purchase agreement is your order confirmation, we are obliged to supply the products listed at the prices shown on this document only.

Payment Types

If purchasing goods using our website checkout, the following methods of credit and debit card payments will be accepted: Visa, Mastercard, Maesto (Switch), Delta, Visa Electron and Solo.

If purchasing goods over the telephone the following methods of credit and debit card payments will be accepted: Visa, Mastercard, Maesto (Switch), Delta, JCB, Visa Electron and Solo.

If purchasing goods by mail we can accept cheques that are made payable to ´Childrens Bed Centres´ and sent to our head office at the following address:

In the case of a cheque payment, we will not despatch any goods until the cheque has properly cleared, this process can take 5-10 days.

Our stores will also accept payments in cash, and cheques that are made payable to ´Childrens Bed Centres´. Once again, in the case of a cheque payment, we are not able to despatch any goods until the cheque has properly cleared, this process can take 5-10 days.

When paying by credit card you have statutory protection covering any goods ordered, in the unlikely event that your goods do not arrive. Furniture orders paid for by credit card may only be delivered to the cardholders billing address.

Customs

Childrens Bed Centres website has been designed for use by Customers living in the UK. Should you live abroad and wish to purchase any products, you must first contact us before placing an order. Furniture and mattresses can only be delivered to mainland UK. In the case of accessories, we reserve the right to refuse an order or to request a further payment from you, to cover international postage costs. When ordering goods for delivery overseas you may be subject to import duties and taxes, which are levied once a package reaches it´s destination. You as the customer are responsible for these charges as we cannot predict when they will be enforced, or how much they will be. As the importer you are also responsible for complying with the laws and regulations of the country in which you are receiving the goods, and where applicable accept that we have no control over cross-border deliveries that are subject to inspection by customs.

Delivery and Installation

Product Availability

Product availability is listed on our site in the form of ´In Stock´ ´Out of Stock´ ´Stock due in XX days/weeks´ or ´X left´. While our stock information is updated regularly, a product should not be considered in stock until an order confirmation has been received from us to the customer. If in the unlikely event you order and pay for items that are not available, you will be contacted immediately and offered a full refund. Childrens Bed Centres will not be liable to pay any compensation and/or losses incurred as a result of an item being unavailable after an order is placed.

Delivery Costs

In the majority of cases the price of posting accessories is free of charge. In the case of furniture, mattresses and larger items, delivery charges are based on where you live in relation to our despatching centres. We regret that we can only look to deliver items to mainland UK. For accurate pricing please enter the postcode of the address you would like furniture to be delivered to into the boxes provided on both our homepage and the delivery section of our website. Some postcodes for remote areas of the UK will not work in our ´delivery fee checkers´, in this instance you will receive a response of ´Price on Application´. If you receive this message, please contact our head office to discuss possible delivery charges and timescales separately.

Delivery Timescales

Delivery estimates are listed on this website by individual item, in the form of ´despatched within XX hours´, ´X-X weeks´ etc. In the majority of cases products classed as accessories are despatched within 2 working days and are then delivered by courier in 1-10 days depending on the item and where you live. In the case of furniture items, various factors can extend the estimated delivery timescales such as, where you live, the complexity of the product ordered, the amount of items ordered etc... Our product ranges vary and on top of this we offer variety in the form of widths, lengths and colours and therefore all furniture is made to order and takes time. It is necessary for us to group deliveries based on area in order to minimise costs to us and charges to our customers therefore, if you live in a remote area you may also have to wait longer than the estimated timescales. We must stress that estimates are approximate and are based on the maximum amount of time an average customer would have to wait for their delivery from the point of ordering. Childrens Bed Centres will not be responsible for any compensation or costs incurred due to a delivery arriving after the estimated timescales.

Furniture Delivery Scheduling

Childrens Bed Centres attempt to give 7 days notice before the arrival of your delivery however, on some occasions such as cancellations this is not possible. Furniture deliveries take place Monday to Friday between the hours of 8am and 6pm and are only scheduled once your items have been manufactured to completion and checked for defects. In the first instance you are contacted using the e-mail address provided by you at the point of ordering. This e-mail will contain information on your proposed delivery date and either an AM, Midday or PM slot. Unfortunately we cannot be more specific than this, as assembly and travelling time can vary and cannot be accurately predicted. If we do not get a response to our e-mail we will attempt to call you on 3 separate occasions. If are unable to contact you 3 days after your initial e-mail was sent, your delivery slot will be offered to another customer. In this instance we will await contact from you before re-arranging your delivery. We regret that while we attempt to meet customers requests it is not always possible due where you live and the volume of deliveries we make each week. Ultimately you, as the Customer are responsible for ensuring that someone is available to accept and sign for delivery at your property on a date and slot specified by our staff.

After arriving at your property, should our delivery team find that the address is unattended, they are only able to wait a maximum of 15 minutes before going to the next customer, due to the amount of time it takes to assemble furniture and travel to the next address. In this instance you would have to pay a further delivery fee before we could re-arrange your delivery.

Parking

In order to complete the assembly of furniture it requires ample and safe parking of our delivery vehicle for the duration of the work. Assembly usually takes from 20-90 minutes depending on the type of furniture ordered. We regret that should safe parking not be provided or available near to your property, our delivery staff will be unable to complete the assembly of furniture.

Access to your property

Assembly of our beds is a complimentary service. The majority of our other childrens furniture such as kids wardrobes and chests of drawers, are delivered ready assembled. Our furniture is designed to fit up the stairs and through doorways of average houses. If your stairway, doorframes, ceiling height, or other structure parts are of an awkward or smaller than average size, it may be necessary to make adjustments to your order of furniture before it is delivered. Providing we are advised of these potential complications when your order is placed or before-hand, we will make these adjustments free of charge. Should we arrive at a property and find that goods will not fit through the route necessary to reach the bedroom, they will have to be returned to our factory for modification and a further delivery charge will be required in order to return the furniture to you. You as the Customer are responsible for making sure that all furniture items and parts are able to pass through the route from our delivery vehicle to the bedroom concerned. If you are unsure about access to your property please contact our head office for guidance.

Floor Protection

Our insurance and health and safety regulations insist that staff assembling furniture must be wearing appropriate footwear to protect them while they work. We regret that staff will be unable to remove their shoes while working in your property and customers are responsible for providing protective floor coverings if necessary.

Some of the furniture items we deliver and/or assemble are heavy. While our staff are trained to carry such objects, they may need to put them down on a number of occasions for a breather or to change their lifting positions on the way to a bedroom. Customers are responsible for providing protective floor coverings to cover any areas (such as wood flooring) that could be damaged from the placement of a heavy object.

In the unlikely event of any damage to your property or its contents during the delivery of your furniture you will need to complete a damage assessment form at the time of the delivery that must be signed by both you and the staff delivering and/or assembling your furniture.

Installation

All measurements and specifications of products are provided on our website. As the customer you are responsible for making sure you order the correct furniture and you accurately measure the room in which furniture will be placed to ensure it will fit. Should we have to return the goods for exchange or modification if the incorrect goods have been ordered or items will not fit in the room specified, a further delivery charge will be required in order to return the furniture to you. If you are unsure about correctly and accurately measuring a bedroom for furniture, please contact our head office for guidance.

Deliveries by Courier service

The majority of our accessories and smaller furniture items are delivered by either the royal mail or a variety of independent courier services. The decision of which courier is used lies solely with Childrens Bed Centres and is determined based on the cost and timeliness of the services available. As with common working practises, if a package requires to be signed for and you or a neighbour are unavailable at the time of delivery, a card will be left giving you instructions on how to either re-arrange delivery of the parcel or pick up the package yourself. Childrens Bed Centres will not be responsible for re-arranging delivery of parcels once despatched. Should an item be returned to us, we would require a fee to re-send the item even if the item was originally sent at no cost to you.

Events beyond our control

Force Majeure: We shall have no liability to Customers for any failure or delay in the delivery or any damage or defect to goods supplied hereunder that is caused by an event or circumstance that is beyond our reasonable control.

Cancellations and Returns

Cancellations

Prior to shipping, any cancellations of furniture orders or mattresses must be made within 7 days of ordering in writing to our head office or by e-mail, in accordance with distance selling regulations. If an item has already been dispatched, please follow the guidelines for returning items.

Any and all refunds can only be made to the same account from which the original payment was made, regardless of the type of product or service bought.

Furniture Returns - Damaged or Defective Items

Should an item of furniture be delivered damaged or defective, we must be informed as soon as possible and within a maximum of 7 days after delivery. We will then look to refund or replace the item at our earliest convenience. The responsibility of determining whether an item is damaged or defective lies solely with Childrens Bed Centres. We reserve the right to refuse to refund or replace any item that has been misused or tampered with after delivery. Should an item not be returned in its entirety, we reserve the right to hold back a portion of the value of goods - determined by us on an individual basis.

Furniture Returns - Other Reasons

In accordance with distance selling regulations, should you wish to cancel your order for products that have been delivered, which are not damaged or defective, you must do so within a maximum of 7 days after delivery. You are entitled to a refund up to the value of goods delivered, less the cost of delivery.

As per the delivery section of these terms and conditions, all goods must be checked and signed for at the point of delivery. Should you inform us that you are not satisfied with your order after delivery, we reserve the right to apply a further fee, of a value not greater than the original delivery charge, for the collection of any items. Any collections will be made at our convenience, only once goods have been returned and checked will a refund be processed. We reserve the right to hold back a portion of the value of goods - determined by us on an individual basis, should items not be returned in their entirety and in the same state and packaging in which they were delivered.

Mattress Returns - Damaged or Defective Items

It is important that all mattresses are thoroughly checked and you are sure that you are completely satisfied with the product at the point of delivery. This is the only time that we can look to refund or replace mattresses for reasons other than what is stipulated in the warranty.

Mattress Returns - Other Reasons

Due to the nature of this type of product and UK health and safety regulations, we are unable to replace or refund mattresses for any reason other than what is stipulated in the warranty unless it is mentioned at the time of delivery. Under no circumstances can mattresses be returned or replaced after being left in a Customers house.

Accessories Returns - Damaged or Defective Items

Should an item be delivered damaged or defective, we must be informed as soon as possible and within a maximum of 7 days after delivery. We will then look to refund or replace the item at our earliest convenience. You are responsible for returning the item to us in its original packaging and in the same condition, in which it was received. If an item is not in the same condition and/or does not have the correct packaging, we reserve the right to hold back a portion of the value of goods - determined by us on an individual basis. Only once an item has been received by us and checked will a replacement or refund be made. You are entitled to a refund of no more than the value of the goods including postage where applicable, at the time it was ordered. We will agree to refund the postage paid by you to return the item/s to us, up to the value of the current royal mail standard packet fees.

Accessories Returns - Other Reasons

Should you wish to return an item that is not damaged or defective, you must inform as soon as possible and within a maximum of 7 days after delivery. You are responsible for returning the item to us in its original packaging and in the same condition, in which it was received, if an item is not in the same condition and/or does not have the correct packaging, we reserve the right to hold back a portion of the value of goods - determined by us on an individual basis. Only once an item has been received, and checked will a replacement or refund be made. You are entitled to a refund of no more than the value of the goods at the time it was ordered, less the cost of delivery. In this instance we are also unable to refund the cost of postage paid by you to ship the goods back to us.

Use of Website

Website Service and Access

Childrens Bed Centres attempt to ensure the smooth running and availability of this website at all times however, due to the nature of the internet uninterrupted service is not guaranteed.

Occasionally it will be necessary for us to complete essential maintenance to this site. At these times, we will do our utmost to insure minimal disruption to our Customers.

Childrens Bed Centres website must not be used by you in a way that is likely to cause interruption to its service, or cause damage to its content or functions.

Account registration and Orders

This website must not be used for any fraudulent or illegal purposes. The registration of a new account with Childrens Bed Centres is made to a single user only. As this user, you are solely responsible for the security of any passwords issued and are not permitted to share usernames or passwords with any other person/s. As the account holder you are responsible for any orders placed using your account, including payment and signing for delivery. You are also responsible for informing us of any changes to your personal details.

Account holders must be over 18 years of age, although our products are for children they may only be purchased by adults.

Electronic communications (e-mails)

When you use our website and send e-mails to us you are communicating with us electronically. By doing this you consent to receive e-mails from us in return and agree that these electronic communications are the equivalent to written communication and therefore would satisfy any legal requirement that such communication be n writing.

You are responsible for any content sent by your computer to Childrens Bed Centres e-mail addresses. You must not send e-mails which cause annoyance or inconvenience, or that impersonates another person or entity, or contains content which misleads Childrens Bed Centres or its staff. Any communications sent by you must not contain viruses or include content which is considered:, Disruptive, offensive or abusive, illegal or fraudulent, obsene or ´Spam´.

Transaction Refusals

We reserve the right to withdraw any transaction for any reason at our sole discretion. We will not be liable to you for our refusal to process a transaction, or for withdrawing or editing any products listed on our website after an order has been placed.

Childrens Bed Centres website offers reciprocal linking to websites deemed to be of use or interest to our customers. Although we allow these links we do not endorse, routinely review or have any control over their websites, and as such cannot be held responsible for their content or availability. Should you choose to use one of these links you will leave this site, at that point we hold no responsibility over the general running of the selected website or the company´s general business practises.

Liability

We reserve the right to make any changes to this website and terms and conditions without notice. You will be subject to the current terms and conditions at the time of your order, with the exception of any changes that are required by law or government authority which will be applicable to any orders placed at anytime past, present or future.

Should we deem any of the terms and conditions void or unenforceable, it will be severed from all other conditions, and will not affect the validity and enforceability of all other conditions.

We make no assurances that our website will meet your requirements and we cannot be responsible for any loss of content or material uploaded or transmitted through this website.

Childrens Bed Centres will not be responsible for any losses suffered by you as a result of breaching these terms and conditions if the losses were reasonably foreseeable by you and us, when you commenced using our website, or an order of products was created.

Our products, services and website have been created for the purpose of retail sales as opposed to trade. Should a business choose to purchase products for any reason including re-sale, we will not be responsible for any losses of profit, revenue, contracts, reputation, goodwill, wasted expenditure or any other consequential loss to that business.

Copyright & database rights

The use of any material content or information in this website is strictly prohibited. All intellectual property rights, trademarks and other content including, software, script, information, logos, images, audio, text, pricing and graphics are the property of Childrens Bed Centres or its affiliates and is protected by English copyright law.

With the exception of links to our homepage from websites deemed suitable and of use or interest to our customers, our consent is required before you copy, download, sell or reproduce any content including logos, for the purpose of publishing, use in other websites, databases or any other commercial activity.

Any unauthorised use of this site or its content terminates the permission granted by Childrens Bed Centres for use.

Waiver

Should you breach these terms and conditions and we choose not to take action, we reserve the right to still use our rights in any other situation where these conditions are breached.

Confidentiality and Data Protection

All confidential information including credit card details are held securely and only transmitted in encrypted form. Customer details are not passed on to third parties and are used in accordance with the data protection act.

Indemnity

As a customer you agree to indemnify us against any claims, losses, liabilities, damages and expenses (including legal fees), arising out of your use of this site.

Statutory Rights

All content included in these terms and conditions does not affect your statutory consumer rights.

Governing Law & Jurisdictions

The terms and conditions and use of this website are governed by the laws of England and Wales. You agree, as we do, to submit to the non-exclusive jurisdiction of the English courts.
